Terms of Use.
These terms (the "EULA") govern your use of the HUSH iOS application. By installing, accessing, or using HUSH you agree to them. If you do not agree, please do not use the app.
1. The agreement
This EULA is a legal agreement between you and the HUSH project ("we", "us"). The agreement is between you and us only; it is not with Apple Inc. We are solely responsible for HUSH and its content.
2. License grant
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use HUSH on any iOS device that you own or control, in accordance with the Apple Media Services Terms and the Usage Rules set out by Apple.
3. Restrictions
You agree not to, and not to permit others to:
- Reverse engineer, decompile, or attempt to extract source code from HUSH except as permitted by law.
- Use HUSH for any unlawful purpose or in violation of any applicable regulation.
- Resell, rent, lease, or sublicense HUSH or any part of it.
- Remove or obscure any proprietary notices.
4. Subscriptions
HUSH offers an optional subscription called HUSH Plus. Subscription pricing, billing cadence, and trial details are described in the in-app paywall and in our Subscription Terms. Purchases are processed by Apple under the Apple Media Services Terms.
5. Health & wellness — not medical advice
HUSH is a personal wellness tool. It is not a medical device, not intended for the diagnosis, treatment, or prevention of any condition, and not intended for contraception. You should consult a qualified healthcare professional for medical advice. Read the full Medical Disclaimer.
6. Your content
You retain all rights to the data you create in HUSH. You grant us a limited license to store, encrypt, and transmit that data solely to provide the app's functionality (sync, predictions, export). We use it only to operate the service for you — never for advertising, profiling, or sale. This license is technical, not editorial.
7. Account
You are responsible for maintaining the confidentiality of your authentication credentials. Tell us at hello@hush.app if you suspect unauthorized access. You can delete your account from Settings → Delete account at any time.
8. Maintenance and support
We are solely responsible for any maintenance and support services related to HUSH. Apple has no obligation to furnish maintenance and support services for the app.
9. Warranty
HUSH is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation the implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law.
In the event of any failure of HUSH to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of HUSH. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to HUSH.
10. Product claims
We, not Apple, are responsible for addressing any claims you have relating to HUSH or your possession and use of it, including: (a) product liability claims; (b) any claim that HUSH fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
11. Intellectual property
In the event of any third-party claim that HUSH or your possession and use of the app infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
12. Legal compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
13. Limitation of liability
To the maximum extent permitted by law, in no event shall HUSH be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the app. Our aggregate liability shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50.
14. Termination
This EULA is effective until terminated. We may terminate it at any time if you breach a provision. On termination you must stop using HUSH and destroy all copies. Sections 9–14 survive termination.
15. Third-party beneficiary
You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
16. Governing law
This EULA is governed by the laws of the State of Delaware, USA, excluding its conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in Delaware. If you live in the EU or UK, this clause does not deprive you of mandatory consumer protections in your country.
